In compliance with Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares), and in order to ensure the protection and privacy of personal data — including regulating access, rectification, cancellation, and opposition to its processing — METAL MANUFACTURING INDUSTRIES S.A. DE C.V. informs you that any personal information you provide will be handled in accordance with this Privacy Notice.

  • Family information.
  • Cardholder name, card number, expiration date, card type (MasterCard / Visa / American Express), security code, and any other information needed for a transaction or online service.

Legal entities (Personas Morales):

  • Business name or corporate name, address, RFC.
  • Articles of incorporation information.
  • Power of attorney granted to the legal representative.
  • Legal representative’s name and email.
  • Names of principal shareholders.
  • Payment information.

The information listed above may be used for some of the following purposes:

  • To provide the services and products requested by our customers.
  • To fulfill obligations undertaken with our customers.
  • To notify customers of changes to our products or services.
  • To evaluate service quality.
  • To conduct internal studies.
  • To promote the services of METAL MANUFACTURING INDUSTRIES S.A. DE C.V.
  • To support hiring, evaluation, and development of personnel.
  • For supplier registration and related purposes.
  • To prepare statistics and reports required by Mexican and foreign authorities.
  • Those related to identification, access, operations, administration, and similar purposes necessary for the provision of administrative and commercial service, as well as for visits to the offices of METAL MANUFACTURING INDUSTRIES S.A. DE C.V.

Personal information provided to the Human Resources department of METAL MANUFACTURING INDUSTRIES S.A. DE C.V. will be used to evaluate your professional profile and aptitudes for possible employment, and — if hired — for employment-related matters and all benefits arising from the employment relationship.

METAL MANUFACTURING INDUSTRIES S.A. DE C.V. may share or transmit the information you provide to third parties who may be interested in your professional profile, so that they may contact you. Information may also be transmitted to third parties for the provision of employment-related benefits.

Finally, the information you provide may be processed in the cases expressly authorized by Article 10 of the Federal Law on the Protection of Personal Data Held by Private Parties.

Notwithstanding the above, METAL MANUFACTURING INDUSTRIES S.A. DE C.V. may disclose your personal data in order to comply with the provisions referenced above and to respond to requirements from judicial and administrative authorities.

III. OPTIONS AND MEANS TO LIMIT THE USE OR DISCLOSURE OF PERSONAL DATA

How can you limit the use or disclosure of your personal data?

METAL MANUFACTURING INDUSTRIES S.A. DE C.V. maintains the administrative, technical, and physical security measures necessary and sufficient to protect your personal data against damage, loss, alteration, destruction, or unauthorized use, access, or processing.

Personal data is safeguarded in databases and on computer equipment with the security controls necessary to prevent information leaks. Physical and logical access controls, environmental controls, intrusion prevention systems, anti-virus protection, and web filtering are among the tools used to secure data in the information systems of METAL MANUFACTURING INDUSTRIES S.A. DE C.V.

The information security tools described above are supported by an internal information security policy that explains to employees the considerations to be taken when using an information system, and is reinforced on an ongoing basis.

METAL MANUFACTURING INDUSTRIES S.A. DE C.V. will limit the use of personal data upon express request by the data subject, and is not required to cancel personal data when:
I. It relates to the parties to a private, corporate, or administrative contract and is required for its performance or compliance;
II. It must be processed by legal requirement;
III. Cancellation would obstruct judicial or administrative proceedings tied to tax obligations, the investigation and prosecution of offenses, or the enforcement of administrative sanctions;
IV. It is necessary to protect the legally protected interests of the data subject;
V. It is necessary to carry out an action in the public interest;
VI. It is necessary to comply with an obligation legally assumed by the data subject; and
VII. It is processed for the prevention of, or medical diagnosis related to, the management of health services, provided such processing is carried out by a health professional subject to a duty of confidentiality.

METAL MANUFACTURING INDUSTRIES S.A. DE C.V. complies with the personal-data protection principles established by the Federal Law on the Protection of Personal Data Held by Private Parties and adopts the measures necessary for its application. This applies even when such data is processed by a third party at the request of METAL MANUFACTURING INDUSTRIES S.A. DE C.V., maintaining confidentiality at all times.

Finally, we note that the websites of METAL MANUFACTURING INDUSTRIES S.A. DE C.V. do not generate cookies or web beacons to store your personal information.

IV. MEANS TO EXERCISE THE RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION, OR OPPOSITION

How to access, rectify, cancel, or object to the use of your personal data.
Every data subject — or their legal representative — has the right to access the personal data we hold and to the details of its processing; to rectify it if inaccurate or incomplete; to cancel it when it is excessive or unnecessary for the purposes for which it was obtained; or to object to its processing for specific purposes. The rights of access, rectification, cancellation, opposition, limitation of use, or withdrawal of consent may be exercised by written request to the Personal Data Processing Area or by email to cwaldo@mmiopenings.com.

Consent may be withdrawn at any time, without retroactive effect. To initiate a withdrawal of consent, please specify the consent you wish to withdraw, either in writing or by email. Your request — written or electronic — for access, rectification, cancellation, or opposition must include:

I. The data subject’s name and address or another means by which we may communicate our response.
II. Documents verifying the identity (or, where applicable, the legal representation) of the data subject.
III. A clear and precise description of the personal data subject to the request.
IV. Any other element or document that facilitates the location of the personal data.
V. In the case of rectification requests, the data subject must indicate the modifications to be made and provide supporting documentation.

METAL MANUFACTURING INDUSTRIES S.A. DE C.V. will respond within twenty business days, counted from the date the request for access, rectification, cancellation, or opposition was received. If the request is well-founded, it will be acted upon within the fifteen days following the communication of the response. In the case of requests for access to personal data, delivery will proceed upon verification of the identity of the requester or their legal representative. The deadlines referred to above may be extended once for an equal additional period, when circumstances justify it.

The obligation to provide access to information is fulfilled by making personal data available to the data subject, or by the issuance of plain copies, electronic documents, or any other means provided by METAL MANUFACTURING INDUSTRIES S.A. DE C.V.

In the event that the data subject requests access from a party they assume to be the controller and that party is not in fact the controller, it will suffice to so notify the data subject by any printed means (a letter of non-applicability) or electronic means (email, optical media, etc.) for the request to be deemed fulfilled.

METAL MANUFACTURING INDUSTRIES S.A. DE C.V. may deny access to personal data, or deny rectification, cancellation, or opposition, in the following cases:

I. When the requester is not the data subject, or the legal representative is not duly authorized.
II. When the personal data of the requester is not found in our database.
III. When third-party rights would be impaired.
IV. When a legal impediment or competent-authority ruling restricts access, or prevents rectification, cancellation, or opposition.
V. When the rectification, cancellation, or opposition has already been carried out.

V. TRANSFERS OF PERSONAL DATA

Your data may be transferred internationally or shared with others.
Your personal data may be transferred and processed within and outside Mexico by parties other than this company but which form part of METAL MANUFACTURING INDUSTRIES S.A. DE C.V. In accordance with Article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties, your information may be shared with entities belonging to METAL MANUFACTURING INDUSTRIES S.A. DE C.V. for the purpose of providing the services required by and fulfilling the requests of the customer.

Except for the exceptions set out in Article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties, we undertake not to transfer your personal information to third parties without your knowledge, and to carry out any such transfer in accordance with the law.

VI. PROCEDURE AND MEANS FOR COMMUNICATING CHANGES TO THIS PRIVACY NOTICE

Amendments to this Privacy Notice.
We reserve the right to amend or update this Privacy Notice at any time, in response to legislative or jurisprudential changes, internal policies, new requirements for the delivery of our services or products, or market practices.

VII. STATEMENT REGARDING SENSITIVE PERSONAL DATA

Collection of sensitive personal data.
METAL MANUFACTURING INDUSTRIES S.A. DE C.V. does not process sensitive personal data.

VIII. CONSENT OF THE DATA SUBJECT

When do you consent to the processing of your personal data?
In accordance with Article 8 of the Federal Law on the Protection of Personal Data Held by Private Parties, consent to the processing of your data is deemed to be given tacitly when, having been made aware of this Privacy Notice, you do not express objection.
